These Terms of Service ("Terms") govern your access to and use of the Sylvia Precision Health platform, website, and related services (collectively, the "Services") provided by Sylvia Precision Health ("Sylvia," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Acceptance of Terms

By creating an account, accessing, or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Sylvia Precision Health.

2. Description of Services

Sylvia provides a digital precision mental health platform for individuals with eating disorders and disordered eating, as well as tools for clinicians and healthcare organizations. Our Services include ecological momentary assessment (EMA) tools, data analysis, Personalized Recovery Roadmaps, coaching support, and clinician-facing treatment planning tools. The specific features available to you depend on your subscription plan.

3. Not a Medical Service

Sylvia is a digital health and wellness platform and is not a licensed medical provider. Our Services are not intended to diagnose, treat, cure, or prevent any medical condition, including eating disorders. The information and recommendations provided through our platform are for informational and wellness support purposes only and do not constitute medical advice.

You should always consult a qualified healthcare professional before making decisions about your health, and particularly before making changes to any existing treatment plan. If you are experiencing a medical emergency, call your local emergency services immediately.

Sylvia is not a crisis service. If you are in crisis or experiencing suicidal thoughts, please contact the 988 Suicide and Crisis Lifeline by calling or texting 988, or contact your local emergency services.

4. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

5. Accounts and Registration

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with others
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

6. Subscriptions and Payment

Certain features of our Services require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are in US dollars unless otherwise specified.

• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds are provided at our discretion and in accordance with applicable law
• We reserve the right to change our pricing with reasonable advance notice

7. Acceptable Use

You agree not to use our Services to:

• Violate any applicable law or regulation
• Provide false or misleading information
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our Services

Our Services are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or completely secure.

We make no representations or warranties regarding the accuracy, completeness, or reliability of any content or information provided through our Services, including Personalized Recovery Roadmaps and related recommendations.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Sylvia Precision Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising out of or related to these Terms or our Services shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our Services will immediately cease. You may terminate your account at any time by contacting us or through your account settings. Provisions of these Terms that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Louisville, Kentucky.
